Welcome to Ounce Jewellery website. These Terms and Conditions govern your use of the website and purchase of goods (“items”) and services from the website. You will also find information on Orders and Returns, your Privacy and Security on other pages of the website and these pages shall be incorporated into these Terms and Conditions.
Please read these Terms and Conditions carefully before using the website. By accessing the website and/or ordering goods (“items”), you indicate your agreement that you accept these Terms and Conditions of use. If you do not accept these Terms and Conditions, do not use this website.
Before placing an order for goods (“items”) you must read and agree to be bound by these Terms and Conditions
By using this website you are confirming that you are at least 18 years of age, or, if you are under the age of 18, that you are accessing the website with consent of your parent or guardian. Your registration and use of the website is void where prohibited.
By placing an order with ouncejewellery.co.uk and/or ouncejewellery.com you are agreeing to receive email newsletters from Ounce Jewellery. If you wish to be removed from our mailing list at any point, simply click on the unsubscribe link provided on any email.
In these Terms and Conditions the following terms shall have the following meanings:

These Terms and Conditions are applicable to all orders and purchases made in our website. With regards to the purchases in our website, we will communicate electronically by sending email. You agree that all agreements, notices, disclosures and other communications that are provided electronically satisfy any legal requirement that such communications in writing. While we guarantee to send you electronic notification of every valid order we receive from you, you will understand that we cannot equally guarantee that the notification we send will be received by you, nor that, if it is received by you, it will be legible and uncorrupted.
You should bear in mind that buying over the internet provides a different shopping experience to buying in-store. In particular you acknowledge that:
· Promotional offers and codes will differ from time to time;
· The colours and photos which are shown for the goods on the website will depend on many factors – including your display settings;
· All sizes, measurements and weights are approximate;
· All goods (“items”) are subject to availability – we may not be able to supply your order;
· Any delivery information given on the website or by email are estimates only.
Ounce Jewellery may revise these Terms and Conditions from time to time. Any changes to these Terms and Conditions will apply to orders placed on or after the effective date stated in these Terms and Conditions or elsewhere on both Terms and Conditions page and/or the website. You are advised to check this page from time to time to take notice of any changes, as they are binding on you.
The description of the goods (“items”), services, price, currency, VAT and delivery cost are set out on the order and/or product page. The advertising of items and services on our website means that your order is an offer and no contract of sale is formed between you and Ounce Jewellery Ltd until we send the ‘Shipment Confirmation’ or ‘Order Dispatched Confirmation’ email which we send to the email address you provided when your goods are dispatched from our centre. This means that we formally accept the order, and are obliged to complete the contract.
The contract is formed on Ounce Jewellery sending the Shipment Confirmation whether or not you receive such email.
We do not have to accept your order, and for example, we will not accept your order if:
· Your payment is not authorised;
· There is an error in our website regarding the price or order details of the goods and/or services.
We reserve the right to refuse any order at our sole discretion.
In exceptional circumstances, if we are not able to fulfil an order we have accepted, you will be fully refunded the total amount you had initially paid to us using the same payment method you used when placing the order and we will notify you by email or phone. In no circumstances will we be liable to you for any additional amounts.
To place an order you must Provide your name and address, phone number, email address, payment details and other required information.You also must provide an eligible delivery address that we ship to. If you are in doubt regarding your shipping to address, please check Section 9 below or email firstname.lastname@example.org for further detail.
You may place an order by clicking on “ADD TO BAG” button and proceeding to the checkout page. You will be provided with an opportunity to review your order, check the total price of your order and the information you have provided and correct any input errors before confirming your order.
Once you have submitted and confirmed your order using our website, we will send an email to the email address you provided acknowledging the receipt of your order (“Order Receipt Confirmation”) and setting out details of the purchased item(s).
After receiving your order, we will check that the relevant item(s) is (are) in stock and we will send you a ‘Shipment Confirmation’ email once the item(s) is (are) dispatched from our centre.
Whilst we try to ensure that all details, descriptions and prices which appear on our website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
You acknowledge that even after Ounce Jewellery has sent you a Shipment Confirmation email, if the pricing error is obvious and could reasonably have been recognised by you as an error, then Ounce Jewellery will be under no obligation to provide the relevant goods to you at the incorrect (lower) price.
All prices throughout the website are quoted in Pounds Sterling are inclusive of VAT but do not include charges for shipping and handling. Separate charges for shipping and handling and their related applicable VAT and/or other taxes will be clearly displayed on screen prior to the completion of your order and included in the “Total Cost”.
Prices for goods and for shipping and handling are liable to change at any time, but changes will not normally affect orders in respect of which we have already sent you a Shipment Confirmation email (save in the case of a manifest pricing error as described above).
To give you a more straightforward service, the prices you pay includes any duties or taxes applicable to the UK, the European Union and USA which we will settle on your behalf. If duty rates change, we reserve the right to charge extra or not supply.
We accept the following payment methods which you should select one from during the checkout process:

- Amazon Pay
- Apple Pay
In the event Ounce Jewellery does not receive the appropriate authorization from your card or payment service provider, or if there were insufficient funds to fulfil the transaction, we reserve the right to reject your order.
However, we may debit your payment card or payment service before a binding contract has been concluded. Such action will under no circumstances constitute acceptance of your offer on our part and, in the event that, we ultimately reject your order, a refund will be made to your payment card.
Please see our Delivery page for information on timings and costs of delivery. We will use our reasonable endeavours to deliver the items or services within the times indicated. However, where delivery times and dates are given, they are for general guidance only and we will not be held liable for late delivery of items caused by circumstances beyond our reasonable control. Delivery shall in any event take place within 30 days after placing your order.
We shall attempt to deliver the items to the address you specify for delivery. You are responsible for making arrangements to receive the items and if the items are held at the post office or other delivery company’s depot because no one was available when the items were delivered then it is your responsibility to quickly collect the items. It is important that the addresses supplied by you to us are accurate.
All our items/parcels require a signature on delivery. It is your responsibility to ensure that there will be someone available at the specified delivery address you provide during normal working hours who can sign for delivery on your behalf. We consider an item is delivered once a signature at the specified address is achieved whether you or someone else signed on your behalf. It is your responsibility to ensure that the recipient is at the delivery address, or to obtain the delivered items from the signatory.
If you unreasonably defer delivery or delay the receipt of delivery after Ounce Jewellery has notified you that the carrier has tried to deliver the ordered items to you, or if you have provided Ounce Jewellery with an incorrect delivery address which results in an unsuccessful delivery, the delivery package will be returned to us, your order will be cancelled and a full refund will be issued to you.
We currently ship to Great Britain and Northern Ireland, the European Union, USA, Canada, Australia and Worldwide. We do not ship to hotels, hostels, prisons, P.O. Boxes and BFPO (British Force Post Office).
It may not be possible for us to deliver to some countries, if an order is received with a delivery address outside the territories stated on our website, you will be contacted by our Customer Care Team. For any delivery query, please email email@example.com
Please note that any duty and/or administration charges incurred by your parcel being delivered overseas (excluding European Union member countries and USA) will need to be settled by you as Ounce Jewellery will not be held liable for these charges.
UK VAT is charged to all shipping locations in the EU. For other destinations, such as USA, no VAT is due but the price you pay remains the same.
If you would like to amend or cancel your order before you have received your Shipment Confirmation email or before you have received the item(s), you must contact Ounce Jewellery Customer Care Team as soon as possible at firstname.lastname@example.org or on +44 (0) 20 8405 8318.
Whilst we will always attempt to amend or cancel your order for you and, where necessary, prevent dispatch of the items, this may not be possible due to the speed with which orders are processed. If we are unable to amend or cancel your order and the items are dispatched to you, you have the option of either refusing to accept the delivery, in which case the items will be returned to us, or accepting the delivery and then returning the items to us in accordance with our Returns and Refunds Policy below.
If the product was not dispatched to you, you will be refunded within the period of 14 days after you inform us of your decision to cancel the order.
Items purchased from our website may be exchanged for the same item in a different size, colour or length or for a different item providing that the desired item is of the same value or less than the initial purchase and subject to availability. No other exchanges are available.
Whenever applicable, you will be refunded any price difference in case your initial purchase was higher than the value of the new desired item.
To exchange your item, you should return it back to us within 30 days of receiving it in its original condition and packaging. The item shall be returned new, unworn and in resalable condition with its dispatch note, item certificate and all relevant documentation. All pierced jewellery items can only be exchanged in their original sealed packaging for hygiene reasons and for the protection of all our customers.
Once we have received, validated and inspected your returned item, we will send you an email to confirm the validation. Your new exchanged item will be shipped to you as soon as possible and within no more than 14 days after we have received your returned item.
Please note that you will be required to cover the return cost of postage if you choose to exchange your item. You have a legal obligation to take reasonable care of the item when they are in your possession until we receive them.

We are certain that you will love your purchase but, on the rare occasion that it is not right, we will be more than happy to offer a refund.
Items purchased from our website may be refunded providing that you return the items to us in their original packaging and with all relevant receipts and documentation within 30 days from the date you have received them. The returned items shall be in their original condition, new, unworn and in resalable condition. Please note that pierced jewellery items can only be returned in their original sealed packaging for hygiene reasons and for the protection of all our customers.
You have a legal obligation to take reasonable care of the items when they are in your possession until you return them.
Please note that you will be required to cover the return cost of postage if you choose to return your purchased items.
We strongly recommend that you send your order back to us via 'Tracked and Signed' delivery service (for example Royal Mail’s Special Delivery) for security reasons. We cannot accept responsibility for items sent by you and lost in transit. For all returns, except where the item is defective, damaged or dispatched in error by us, you will be required to arrange and pay for the returns of the items to us.
For on promotion or sale items (for example, buy one get one free or buy one get another item at a reduced price) you must return all purchased items including the free or reduced price items to us to process a refund.
Once we have received, validated and inspected your returned items, we will send you an email to confirm the validation. Any refund due to you will be made as soon as possible and in any event of 14 days after the day on which we receive the items back from you.
In the event that we do not receive your returned items, we will ask you to provide the shipment tracking number with proof of postage receipt you obtained from the post office or delivery company. We reserve the right to refuse a refund if you are unable to provide the shipment tracking number and proof of postage. We also reserve the right to refuse a refund where the item is returned damaged or showing signs of use or wear.
We will refund you by the same method you used to make payment. We will refund you the full price you paid for the items (including VAT and/or other taxes) together with any applicable standard delivery cost if paid initially (excluding any additional cost paid for premium delivery service, such as Saturday delivery service).
Please note that we are permitted by law to reduce your refund to reflect any reduction in the value of the items, if this has been caused by your handling them in a way which would not be permitted in a shop.

Should you receive an item you have ordered that is defective, damaged or not what you ordered, please contact us as soon as possible. You must return any defective, damaged or incorrect item to us within 30 days of receiving the item. You may then choose to receive a replacement item or full refund.
Where the item is defective, damaged or dispatched in error by us, we will refund the price of the item in full, together with any paid cost for our standard delivery including the postage cost incurred returning the item back to us.
Please note that repairs or attempted repairs to our items will void our Returns Policy set out in these Terms and Conditions whether or not damage has been caused by such repair or attempted repair.
Ounce Jewellery warrants to you that any item purchased from our website is of satisfactory quality and reasonable fit for all the purposes for which items of the kind are commonly supplied.
We reserve the right to change, modify, substitute or remove without notice any information on the website from time to time. We will endeavour to ensure that all descriptions and illustrations of the items on the website or in our catalogue or otherwise provided to you by us are accurate but there may be slight variations due to print and publishing limitations.
We constantly work to keep the website up to date but cannot guarantee that this website and its contents are completely free of technical errors, viruses, or anything else that may have a harmful effect on any technology. We will endeavour to allow uninterrupted access to the website but access may be suspended, restricted or terminated at any time. By using this website, you acknowledge that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with this website.
In no event shall we be liable for any indirect loss, consequential loss, loss of profit (whether direct or indirect), data, revenue, business opportunity, anticipated savings, goodwill or reputation whether in contract, tort or otherwise arising out of or in connection with the Terms and Conditions or use of the website.
These Terms and Conditions set out the full extent of the obligations and liabilities of Ounce Jewellery in respect of the sale of the goods online. To the extent permitted by applicable law, there are no other warranties, conditions or other terms that are binding on Ounce Jewellery other than those set out in these Terms and Conditions.
You must use the website for lawful purposes only. If we allow you to register with us you are fully responsible and liable for all access made to the website using any password or user name that you register with us. You should keep such passwords and user names confidential at all times.
Nothing in these Terms and Conditions affects your legal rights as a consumer. To the full extent permitted by law, our liability to you in connection with any claim or series of connected claims shall be limited to the amount actually paid for the purchase of the applicable items from Ounce Jewellery.
Notwithstanding anything else in these Terms and Conditions, we do not exclude or limit our liability in respect of death or personal injury caused by our negligence or for fraud or fraudulent misrepresentations.
We shall not be liable to you or in breach of these Terms and Conditions for delay or failure to preform if the delay or failure is due to a cause beyond our reasonable control.
Ounce Jewellery cannot be held liable for any item that has been repaired or modified by a third party.
Ounce Jewellery cannot guarantee that the sale and delivery of its items to your particular country or location is permissible, so please be aware of your own geographical import restrictions.
This website and its contents will not constitute the basis for any contractual commitment between Ounce Jewellery and any prospective customer in any jurisdiction in which the solicitation of interest or the offering of or sale of items by Ounce Jewellery would contravene any applicable local, regional, or national legislation. No prospective customer should seek to make any order through the website from jurisdiction in which it would be illegal for Ounce Jewellery to sell items.
Your use of this website and any contract between you and Ounce Jewellery for the sale of items shall be governed by and shall be construed in accordance with the laws of England and Wales and shall be subject to the non-exclusive jurisdiction of the Courts of England and Wales. If any provision of these Terms and Conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity or enforceability of any remaining provisions. Unless otherwise stated in these Terms and Conditions, no part of these Terms and Conditions are enforceable by anyone who is not a party to them, pursuant to the Contracts (Rights of Third Parties) Act 1999.
You acknowledge and will respect all such intellectual property rights we own or may own or those owned by a third party that are part of this website and its contents including any sounds, music, text, graphics, data, stills, photographs, moving images, illustrations, designs, site layout, written and other text or script. Such intellectual property rights shall include any registered and unregistered intellectual property rights, rights of any type or nature including trademarks, community and other marks.
